TERMS OF SERVICE AGREEMENT

IMPORTANT: This Terms of Service Agreement ('Agreement') is a legally binding contract between you and The Compatibility Clinic. Please read it carefully before using our services. By purchasing a membership or using our services, you agree to be bound by this Agreement, our Privacy Policy, and any additional terms disclosed at the time of purchase.

 

1.  ACCEPTANCE OF TERMS

This Agreement is an electronic contract that establishes the legally binding terms you must accept to use The Compatibility Clinic's services ('Services'). This Agreement incorporates The Compatibility Clinic's Privacy Policy by reference and any terms disclosed and agreed to by you if you purchase or accept additional features, products, or services we offer.

By purchasing a membership or using our Services, you agree to be bound by this Agreement. Your contract with The Compatibility Clinic commences on the date we receive your first payment, regardless of whether you have separately executed a Membership Agreement. The membership purchased is personal to you as the named member and may not be transferred to any other person.

We may update this Agreement from time to time to reflect changes in law, new features, or changes in business practices. The most recent version will be posted on our website at compatibilityclinic.com. If changes include material modifications that affect your rights or obligations, we will notify you by reasonable means, which may include notification through the Services or via email. Your continued use of the Services after changes become effective constitutes acceptance of those changes. If you do not agree to the changes, you must cease using the Services and terminate your membership.

 

2.  ELIGIBILITY

You must be at least 18 years of age to create an account or use the Services. By creating an account and using the Services, you represent and warrant that:

  • You are at least 18 years of age

  • You have the legal capacity to form a binding contract with The Compatibility Clinic

  • You are not a person barred from using the Services under the laws of the United States or any other applicable jurisdiction

  • You are not currently in a committed romantic relationship at the time of enrollment

  • All information you provide is truthful, accurate, and complete

  • You will comply with this Agreement and all applicable laws and regulations

 

We reserve the right to decline any application for membership at our sole discretion and without obligation to provide a reason. In the event we determine that any information you have provided is misleading or inaccurate, we reserve the right to terminate your account.

 

3.  NATURE OF SERVICES

The Compatibility Clinic provides personalized, concierge-style matchmaking and dating support services. These services may include compatibility assessments, curated introductions, coaching, and relationship guidance.

Important Disclaimer: The Compatibility Clinic does not provide psychotherapy, counseling, or mental health treatment. Participation in our Services does not establish a therapist-client or counselor-client relationship, even if services are informed by psychological principles or administered by licensed professionals. Clients are encouraged to seek separate, qualified mental health providers for any therapeutic needs.

 

3.1  Use of Psychological Tools

Our Services may incorporate personality assessments, attachment-style frameworks, and compatibility profiling tools. These tools are:

  • Informational and non-diagnostic in nature

  • Not a substitute for clinical evaluation or mental health treatment

  • Used solely to enhance matching compatibility, not to label, diagnose, or treat any condition

 

3.2  Licensed Professionals Acting in Matchmaking Role

If services are provided by individuals who hold professional licenses (e.g., therapists, counselors, social workers), those individuals are acting solely in a matchmaking and consultative capacity when delivering The Compatibility Clinic's services. No therapeutic relationship is formed, and no professional duty of care arising from a clinical relationship is created by their participation in the delivery of matchmaking services.

 

4.  MEMBERSHIP TERMS

Your matchmaking service commences after your profiling interview and our receipt of all necessary documents, including your approval of your dating profile.

 

4.1  Member Obligations

As a member, you are required to:

  • Not be in a committed romantic relationship at the time of requesting matchmaking services

  • Provide true, accurate, and complete information at all times

  • Notify us promptly if you begin a new relationship, if there is any change in your availability for introductions, or if there has been any significant change in your personal circumstances that may require updating your dating profile

  • Maintain regular contact with us and respond to our communications in a timely manner

  • Engage respectfully and in good faith with the matchmaking process

 

4.2  Profile Accuracy and Member Verification

Whilst all members are interviewed and identity verified, we accept the particulars given to us in good faith and rely on members to keep us updated of any change. We advise you to verify the particulars of others for yourself. We cannot accept liability for the validity of information provided by other members. The care taken by us in sourcing others to recommend to you does not absolve you of personal responsibility for your own safety and security during meetings or relationships with those we introduce you to.

Your safety is our priority. We strongly advise you to read our Dating Safety Handbook and to take sensible precautions when meeting any person for the first time.

 

4.3  Conduct Standards

The Compatibility Clinic is a platform for people who are serious about meeting compatible partners. We do not support untrustworthy or unreliable behavior. Specifically:

  • If you cancel or fail to attend a scheduled date on two or more occasions, your account may be partially restricted for a 24-hour period during which no further introductions can be arranged

  • Repeated offenses may result in permanent termination of your membership at the Company's sole discretion

  • Upon termination or suspension resulting from conduct violations, you will not be entitled to any refund of unused service fees

 

5. RECOMMENDATIONS AND INTRODUCTIONS

 

5.1  Recommendations

Where included in your Membership Agreement, 'Recommendations' are defined as profiles of other members selected and presented to you on a one-at-a-time basis. You acknowledge that:

  • We do not guarantee the outcomes of Recommendations

  • Those we recommend to you will not necessarily agree to proceed further or to meet you, as the choices of other members are outside our control

  • All Recommendations will be counted toward any number of Recommendations specified in your Membership Agreement, regardless of whether either party agrees to an introduction

  • No guarantee is given that any Recommendation will satisfy all of your stated partner preferences

 

5.2  Confirmed Introductions

Where included in your Membership Agreement, 'Confirmed Introductions' are defined as instances where both you and the person recommended to you agree to be put in contact with each other. You acknowledge that:

  • A Confirmed Introduction does not imply any guarantee of a meeting or of a successful relationship

  • All Confirmed Introductions will count toward any number specified in your Membership Agreement

 

5.3  Discretion in Recommendations

We reserve the right and absolute discretion to recommend members to you whom we consider may be compatible, even where those persons may only match your stated partner preferences to a degree. This approach has proven effective for many of our clients. Where we believe your stated partner preferences are unrealistically restrictive, we may discuss this with you and suggest widening your preferences to facilitate more introductions.

 

5.4  Service Guarantee

We will fulfill our obligation to supply Recommendations or Confirmed Introductions as specified in your Membership Agreement, extending the service period if necessary, subject to all of the following conditions:

  • There has been no change in your personal circumstances or partner preferences after your profiling interview that makes matchmaking significantly more difficult or impossible

  • Where Confirmed Introductions are specified, this guarantee is limited to either achieving the stated number of Confirmed Introductions or supplying at least twice that number as Recommendations, regardless of whether those Recommendations progressed to Confirmed Introductions

  • You have remained available and maintained contact with us to receive Recommendations throughout your membership period

 

6.  FEES AND PAYMENT

There is a fee to become a member of The Compatibility Clinic. All fees, packages, and membership terms will be outlined in your separate Membership Agreement. By accepting this Agreement and purchasing a membership, you agree to the fee structure set forth in your Membership Agreement.

  • All fees are generally non-refundable unless otherwise expressly stated in writing or as required by applicable law (see Section 8 for cancellation rights)

  • Services are time-limited and scope-specific as described in your Membership Agreement

  • We do not guarantee a minimum or maximum number of dates as part of our Services or membership

 

7.  MEMBERSHIP SUSPENSION AND FREEZE

 

7.1  Voluntary Membership Freeze

Where a membership freeze facility is included in your Membership Agreement, you may suspend your service and freeze your membership for periods of at least one full calendar month. It remains solely your responsibility to inform us when you wish to reactivate your service after a freeze.

Where a freeze facility included in your agreement is exceeded, the following provisions apply:

  • Your membership service time will continue to run as if the membership were active

  • It remains your responsibility to notify us if you wish the service to be reactivated

  • Your membership will expire once your membership time has elapsed

  • We will not be required to meet any guarantees for Recommendations or Introductions where the freeze facility has been exceeded beyond the maximum time permitted in your Membership Agreement

 

7.2  Medical Suspension

Should you experience the onset or exacerbation of a serious medical condition or suffer a serious injury, your services may be suspended for up to one year at the Company's sole discretion, provided you notify us at the time of onset. In such instances, no service time or freeze facility time will be lost — the suspension period will be added to your membership service term.

 

7.3  Suspension Pending Investigation

If we are investigating any aspect of your membership or conduct, your membership may be suspended during the period of investigation. No service time or freeze facility time will be lost during a company-initiated investigation — the investigation period will be added to your membership service term.

 

7.4  Criminal Charges

If you are charged with a criminal offense, you must notify us immediately. Your service will be suspended pending the outcome of any prosecution. We reserve the right to terminate your membership upon conviction.

 

7.5  Non-Response Suspension

If you repeatedly fail to respond to our communications, your service may be suspended as a courtesy to other members. In such instances, any available freeze facility time will be applied. If no freeze facility time is available or has been exceeded, your membership service time will continue to run as if the membership were active.

8.  CANCELLATION AND REFUND POLICY

 

8.1  Right to Cancel — 14-Day Cooling-Off Period

Your contract with The Compatibility Clinic commences on the date we receive your first payment. In accordance with applicable US consumer protection law and as a matter of company policy, you have the right to cancel this contract for any reason within 14 calendar days of the date your contract commences (the 'Cancellation Period') without incurring a cancellation penalty, except as described below.

To exercise your right to cancel within the Cancellation Period, you must notify us of your decision by clear written statement via:

To meet the cancellation deadline, it is sufficient for you to send your communication before the Cancellation Period has expired.

 

8.2  Effect of Cancellation Within the Cooling-Off Period

If you cancel within the Cancellation Period:

  • We will reimburse all payments received from you, without undue delay and no later than 14 days after receiving notice of your cancellation, unless services have already commenced at your request

  • If you request that services begin within the Cancellation Period ('Express Request'), your right to cancel continues until the earlier of the end of the Cancellation Period or completion of the services

  • If you cancel after services have commenced at your Express Request, we will charge you a proportionate amount for services provided up to the point of cancellation and refund the remainder

 

8.3  Cancellation After the Cooling-Off Period

You may terminate your membership at any time after the Cancellation Period by written notice to us via mail or email. However:

  • This contract is for the maximum service term detailed in your Membership Agreement

  • Fees paid are non-refundable for early voluntary termination after the Cancellation Period

  • The service and fee are not divisible on a pro-rata basis — if you change your mind or no longer require the service before the end of your contract term, no portion of the fee is refundable

  • You will not be entitled to a refund for any reason other than your legal right to cancel within the 14-day Cooling-Off Period, or where The Compatibility Clinic has materially breached this Agreement

 

8.4  Company-Initiated Termination and Refunds

In the event The Compatibility Clinic terminates your membership, no refund will be applicable unless we have materially breached this Agreement or your applicable consumer rights. See Section 9 for termination circumstances.

 

9.  TERMINATION OF MEMBERSHIP

The Compatibility Clinic reserves the right to suspend or terminate your membership at any time, with or without cause. Circumstances that may result in termination include:

  • Misrepresentation or provision of inaccurate, false, or misleading information

  • Safety concerns relating to your conduct or behavior

  • Violation of any provision of this Agreement

  • Failure to maintain contact or respond to our repeated communications for a period exceeding six months

  • Receipt of a serious complaint or persistent complaints about your conduct which, in the sole opinion of the Managing Director, justifies termination

  • A significant change in your personal details or partner preferences — including relocation or acquisition of a criminal record — that materially and adversely impacts the number of Recommendations available from our database

  • Criminal charges or conviction for a serious offense

  • Conduct that is abusive, harassing, or threatening toward members, staff, or agents of The Compatibility Clinic

 

We also reserve the right to decline or terminate services at our sole discretion, including for reasons not listed above. For the avoidance of doubt, in the event of termination by us, no refund will be applicable unless we have materially breached this Agreement.

 

10.  BACKGROUND CHECKS

The Compatibility Clinic conducts background checks on all members as part of our safety and verification process. This is consistent with our Privacy Policy, Section 4.2, which contains full FCRA-compliant disclosures. Please review the Privacy Policy for complete information about your rights regarding background checks.

 

As a condition of membership, The Compatibility Clinic conducts background checks on all members using a third-party consumer reporting agency. Background checks may include identity verification, criminal history records, sex offender registry searches, and other public record information. These checks are conducted in accordance with the Fair Credit Reporting Act (FCRA) and applicable Nevada law.

 

By applying for membership, you authorize The Compatibility Clinic to obtain a consumer report about you. A separate FCRA Disclosure and Authorization form will be provided to you prior to any background check being initiated. If a background check results in an adverse action (such as denial of membership), you will be provided with all required FCRA notices including a copy of the report and a summary of your rights.

Notwithstanding the foregoing, The Compatibility Clinic cannot guarantee the completeness or accuracy of background check information, and members remain solely responsible for exercising personal judgment and safety precautions when meeting other members. Background check results are not shared with other members.

 

11.  NO GUARANTEE OF OUTCOMES

While we strive to create highly compatible matches and meaningful connections, The Compatibility Clinic makes no guarantee of romantic matches, relationships, or specific outcomes. Specifically:

  • Compatibility assessments and recommendations are subjective and interpretive, not predictive

  • Success depends on multiple factors outside our control, including individual effort, timing, and interpersonal dynamics

  • We do not guarantee a minimum or maximum number of dates, introductions, or matches

  • The choices made by other members — including whether to proceed with an introduction — are entirely outside our control

 

12.  CONDUCT AND SAFETY

To maintain a safe, respectful, and productive environment for all members and staff:

 

12.1  Member Conduct Standards

You agree to:

  • Provide accurate, honest, and complete information at all times

  • Engage in the matchmaking process with respect, integrity, and accountability

  • Communicate openly about your preferences, boundaries, and concerns

  • Take full responsibility for your own dating decisions and actions

  • Treat all members, staff, and agents of The Compatibility Clinic with courtesy and respect

  • Not harass, intimidate, stalk, or cause distress, anxiety, or harm to any person you are introduced to or any employee or agent of The Compatibility Clinic

  • Not do anything that restricts or inhibits another person's use and enjoyment of our services

  • Not engage in any conduct that deliberately or recklessly damages the reputation of The Compatibility Clinic

 

12.2  Personal Safety Responsibility

You are solely responsible for your interactions with other members. The Compatibility Clinic is not responsible for the conduct of any member. You agree to take all necessary precautions in all interactions with other members, particularly if you decide to communicate or meet outside of our facilitated introduction process.

In no event shall The Compatibility Clinic, its affiliates, or partners be liable (directly or indirectly) for any losses or damages arising out of or relating to the conduct of you or anyone else in connection with the use of our Services, including, without limitation, death, bodily injury, emotional distress, or any other damages resulting from communications or meetings with other members.

 

12.3  Prohibited Activities

You agree not to engage in the following activities:

  1. Impersonate any person or entity or misrepresent your affiliation with any person or entity

  2. Solicit money from any member or engage in any fraudulent activity

  3. Stalk, harass, or intimidate any member or staff member

  4. Use the Services in an illegal manner or to commit any illegal act

  5. Collect personal information of other members for any purpose other than personal use in connection with the Services

  6. Post, upload, or share content that promotes racism, bigotry, hatred, or physical harm of any kind

  7. Post content that advocates harassment or intimidation of another person

  8. Share or distribute content that exploits people in a sexual, violent, or other illegal manner

  9. Share content that contains personal information of another person without their consent

  10. Post content that is false, misleading, defamatory, or libelous

  11. Modify, adapt, sublicense, translate, sell, reverse engineer, or decompile any portion of the Services

  12. Use the Services for any commercial purpose, including advertising or soliciting members to buy or sell products or services

 

The Compatibility Clinic reserves the right, in its sole discretion, to investigate and take any legal action against anyone who violates this section, including suspending or terminating the account of any violator.

 

13.  CONFIDENTIALITY AND PRIVACY

The Compatibility Clinic values discretion and confidentiality. Your personal information will be handled with reasonable care and in accordance with our Privacy Policy, which is incorporated into this Agreement by reference and available at compatibilityclinic.com.

 

13.1  Member Confidentiality Obligations

You agree not to:

  • Disclose the identity, personal information, or profile details of any member introduced to you, to any other person, media outlet, or online platform, without the explicit written permission of both The Compatibility Clinic and the member concerned

  • Discuss or share details of other members provided to you with any other member or non-member, during or after your membership

  • Record or photograph any member without their explicit prior consent

 

13.2  Our Confidentiality Obligations

The Compatibility Clinic will:

  • Handle your personal information in accordance with our Privacy Policy and applicable privacy law, including Nevada Revised Statutes Chapter 603A

  • Share your profile information with potential matches only to the extent necessary to facilitate introductions, and only with your knowledge

  • Not use your personal information for purposes unrelated to the provision of our Services without your separate, explicit consent

 

13.3  Limits of Confidentiality

Absolute confidentiality cannot be guaranteed once introductions are made, as we have no control over the conduct of other members after an introduction. We may also be required to disclose information in the following circumstances:

  • In response to a valid subpoena, court order, or request from a law enforcement or government agency

  • To establish, exercise, or defend our legal rights

  • To protect the rights, property, or safety of The Compatibility Clinic, our members, or others

  • In connection with a corporate transaction such as a merger, acquisition, or sale of assets

  • Where otherwise required by applicable law

14.  CONTENT AND INTELLECTUAL PROPERTY

 

14.1  Member Content License

By submitting content to The Compatibility Clinic (including profile photographs, personal descriptions, and other profile materials), you grant The Compatibility Clinic a limited, non-exclusive, non-transferable, non-sublicensable license to store, display, and use that content solely for the purpose of providing our matchmaking services to you — including displaying your profile to potential matches and to our internal matchmaking staff.

This license is limited to the operation of our matchmaking services. We will not use your photographs or personal profile content in advertising or marketing materials without your separate, explicit written consent. You retain full ownership of all content you submit.

 

14.2  Prohibited Content

You may not post, upload, or share content that:

  • Promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual

  • Advocates harassment or intimidation of another person

  • Contains or solicits personally identifying information from any person under the age of 18

  • Provides false or misleading information or promotes illegal activities

  • Contains video, photographs, or images of another person without their consent

  • Infringes the intellectual property rights of any third party

  • Contains viruses, malware, or other harmful code

  • Solicits money from or attempts to defraud other members

 

14.3  Company Intellectual Property

The Compatibility Clinic owns and retains all proprietary rights in the Services, including all content, trademarks, trade names, service marks, and other intellectual property rights. You agree not to copy, modify, transmit, create derivative works from, or reproduce any copyrighted material, trademarks, or proprietary information accessible through the Services without prior written consent.

 

15.  PHOTO AND VIDEO AT EVENTS

The photo/video release has been narrowed from the prior version to require explicit written consent before any member's image is used in marketing or advertising, consistent with The Compatibility Clinic's confidentiality commitments.

The Compatibility Clinic may hold in-person events from time to time. If photography or video recording will take place at an event, we will notify attendees in advance. By attending a Company event where photography or video recording is occurring:

  • You acknowledge that general event photographs or footage may be taken that may incidentally include your image

  • We will not use any photograph or video in which you are identifiable in advertising, marketing, or public-facing materials without first obtaining your separate, explicit written consent

  • You may opt out of event photography by notifying our staff at the event

If you provide written consent for the use of your image, you grant The Compatibility Clinic the right to use such photographs or video for the specific purposes described in your consent form. You may withdraw consent at any time by contacting us in writing at info@compatibilityclinic.com, though withdrawal will not affect any use that occurred prior to receipt of your withdrawal.
 

16.  DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPATIBILITY CLINIC PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS AND MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

THE COMPATIBILITY CLINIC DOES NOT REPRESENT OR WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE

  • ANY DEFECTS OR ERRORS WILL BE CORRECTED

  • ANY CONTENT POSTED BY MEMBERS IS ACCURATE, COMPLETE, OR RELIABLE

  • THE SERVICES WILL RESULT IN ROMANTIC MATCHES, INTRODUCTIONS, OR RELATIONSHIPS

 

You acknowledge and agree that The Compatibility Clinic and its affiliates are not responsible for, and shall have no liability for, any loss or damage, including personal injury or death, arising from:

  • Any inaccurate or incomplete content posted by members

  • The conduct of any member, whether online or offline

  • Any error, delay, or failure in the delivery of the Services

  • Unauthorized access to your account or personal information

 

17.  LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPATIBILITY CLINIC, ITS AFFILIATES, BUSINESS PARTNERS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF GOODWILL, DATA LOSS, SERVICE INTERRUPTIONS, OR PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF THE COMPATIBILITY CLINIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE COMPATIBILITY CLINIC'S TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO THE COMPATIBILITY CLINIC FOR THE SERVICES DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

NOTHING IN THIS AGREEMENT SHALL LIMIT OR EXCLUDE THE COMPATIBILITY CLINIC'S LIABILITY WHERE SUCH LIMITATION OR EXCLUSION IS PROHIBITED BY APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, FRAUD, OR WILLFUL MISCONDUCT.

 

18.  RELEASE AND ASSUMPTION OF RISK

By using our Services, you acknowledge and voluntarily assume the inherent risks associated with meeting other people through a matchmaking service, including in-person meetings arranged through or facilitated by The Compatibility Clinic. You understand that:

  • The Compatibility Clinic is not liable for the behavior, actions, or representations of other members

  • We are not responsible for outcomes of introductions or relationships

  • You assume full personal responsibility for your safety and decision-making in all interactions with other members

  • The background checks we conduct, while comprehensive, cannot guarantee the accuracy or completeness of all information about a member

 

In consideration of the Services provided, you hereby release The Compatibility Clinic, its officers, employees, agents, and representatives from any liability for injury, damage, or loss of any kind arising from your participation in our Services or from meetings with other members, to the fullest extent permitted by applicable law. Nothing in this release is intended to waive liability for gross negligence, fraud, or willful misconduct.

 

19.  INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Compatibility Clinic, its subsidiaries, affiliates, and their respective officers, directors, agents, partners, and employees from and against any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party arising out of or relating to:

  • Your breach of this Agreement

  • Your violation of any applicable law or regulation

  • Content you submit to the Services

  • Your interactions with other members

  • Any misrepresentation made by you

 

The Compatibility Clinic reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which event you agree to fully cooperate with us.

 

20.  COMPLAINTS AND DISPUTE RESOLUTION

 

20.1  Internal Complaints Process

If you are unhappy with any aspect of our Services or the conduct of another member, you agree to contact us promptly with sufficient detail to allow us to address the situation. We are committed to handling all complaints in a timely and professional manner.

20.2  Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles.

 

20.3  Dispute Resolution — Arbitration

Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Services that cannot be resolved informally shall be resolved by binding arbitration in Clark County, Nevada under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent immediate or irreparable harm. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: To the fullest extent permitted by law, you and The Compatibility Clinic agree that each party may only bring claims against the other in an individual capacity and not as a plaintiff or class member in any class or representative action or proceeding.

 

21.  MODIFICATIONS TO SERVICES

The Compatibility Clinic reserves the right at any time to modify or discontinue, temporarily or permanently, the Services or any part thereof, with or without notice. You agree that The Compatibility Clinic shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services. To protect the integrity of the Services, we reserve the right to block access from certain IP addresses or devices at our sole discretion.

 

22.  MEDIA AND TESTIMONIALS

With your prior written consent, The Compatibility Clinic may:

  • Use anonymized success stories or testimonials in our marketing materials

  • Reference your experience in general terms without identifying information

 

No identifying information — including your name, photograph, or personal details — will be used in any marketing or testimonial context without your explicit, separate written authorization. You may withdraw your consent at any time by contacting us in writing.

 

23.  NON-COMMERCIAL USE

The Services are for personal use only. You may not use the Services or any content available through the Services in connection with any commercial activity, including advertising or soliciting any member to buy or sell products or services not offered by The Compatibility Clinic. Organizations, companies, and businesses may not use the Services without The Compatibility Clinic's express prior written consent.

 

24.  GENERAL PROVISIONS

 

24.1  Entire Agreement

This Agreement, together with the Privacy Policy and any specific guidelines or terms contained in your Membership Agreement or separately posted for particular services, constitutes the entire agreement between you and The Compatibility Clinic regarding the use of the Services and supersedes all prior agreements and understandings.

 

24.2  Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.

 

24.3  Waiver

The failure of The Compatibility Clinic to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

 

24.4  No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of this Agreement. You may not make any representations or bind The Compatibility Clinic in any manner.

 

24.5  Notices

All notices to The Compatibility Clinic under this Agreement should be sent to:

 

24.6  Subordination Clause

The terms contained in this Agreement are subordinate to any contrary terms contained in any express Membership Agreement or express written agreement containing the signatures of authorized representatives of both parties.
